    Extending Contracts

     

    Hi

    If, on completion of an RFT document ( EU threshold), there was a provison put in place that the contracting authority may extend the contract for a further term on completion the project, does that fully cover the Contracting Authortiy from having to go to tender again?  The wording is   "option for renewal for another year should the CA decide to repeat the initiative again in 2009".  The new contract (which would obviously be with the same vendor again) would be almost the same as the last except for some small modifications which are due to the CA now understanding exactly want it needs for the project. 

    Bearing this in mind, can anyone confirm for me that it is okay to proceed with the same vendor again without going to the market again?

    I wouldn't claim to be an expert on these matters. I was advised (by a source who knows a thing or two about these issues), that once the provision for extension of the contract was included in the original tender AND the price remains the same for the extended contract, there is no need to retender.

    If the possibility of extending the contract was made clear at the time of going to tender, and the cost of the service for the intended extended period included in the cost estimation, there should not be a problem.
